PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY before using the website of the Boston Security Analysts Society, Inc. ("BSAS") and purchasing and using the BSAS CFA Practice Exam (the "Exam"). These Terms and Conditions must be accepted before you can print or use the Exam. By purchasing and using the Exam, you signify your understanding of and agreement to these Terms and Conditions. BSAS may revise and update these Terms and Conditions at any time, without notification to you. Please periodically review the Terms and Conditions. BSAS grants you a limited and revocable license to access and use this Exam strictly in accordance with these Terms and Conditions. At all times, BSAS reserves the right to revoke this license and discontinue any and all services to you without cause and without prior notice.

  1. This Exam is provided solely as a preparation aid for the Chartered Financial Analyst examination and is not intended for use as a preparation aid for any other examination. This Exam is owned and administered by BSAS and CFA® and Chartered Financial Analyst™ are trademarks owned by the CFA Institute. All rights reserved. BSAS assumes no responsibility, and shall not be liable for, any unauthorized use of this Exam, the trademarks, or other intellectual property of the CFA Institute or BSAS by any other party.
  2. Purchase and Use. Your purchase of the Exam entitles you to download and print only one (1) copy of the Exam. There are no refunds on this purchase. It is solely your responsibility to acquire the appropriate software to enable such download and print. No part of the Exam may be reproduced, stored in a retrieval system, transmitted or distributed, in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise without the written permission of BSAS. The Exam may be retrieved solely for your own personal, non-commercial use. No other use of the Exam is permitted without the written consent of BSAS. You may not remove or alter any trademark, copyright, or other proprietary notice contained therein. The contents of the Exam are protected by copyright and other intellectual property rights and are the exclusive property of their respective owners, including BSAS, and all rights therein are reserved. Any unauthorized downloading, transmission, or other copying of materials related to the Exam, including trademarks and trade names, may violate federal, state, common or civil law trademark and copyright law, and may result in legal action. The Exam is based on the Learning Outcome Statements® for the 2008 Body of Knowledge®. The Exam will not provide you with an actual grade. It will only show you the number of questions answered correctly. Please note the Exam is not based on the actual exam. It is intended as a study tool only.
  3. Addendum. Please note that this Exam may be updated with an Addendum to be provided at a later date on the BSAS website. Any Addendum will be provided to Exam purchasers free of charge. It is your sole responsibility to log onto the BSAS website for any Addendum, and BSAS will not send out any notification that an Addendum has been posted. These Terms and Conditions shall be applicable to and govern any Addendum. 4. Disclaimer. BSAS makes no representations about the accuracy, reliability, completeness, or timeliness of the material on the Exam or about the results to be obtained from using the Exam. You use the Exam at your own risk. Changes are periodically made to the website and Exam and may be made at any time without notice. TO THE EXTENT PERMITTED BY STATE, LOCAL, OR OTHER APPLICABLE LAW, THE EXAM IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.   4. Worldwide Access. This site is controlled by BSAS from its offices in Boston, MA, USA. If you access the website from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
  5. Privacy Statement. BSAS is the sole owner of any information collected from you on or through this website, including any personal or financial information that you may provide. BSAS will not share, sell, or otherwise provide this information to others in any manner other than as outlined herein. BSAS collects information in order to process commercial transactions and will only use personal information for such and to contact you with regards to your use of the website or the Exam, as appropriate. BSAS takes every precaution to protect our website users’ information. BSAS may share any collected information with our partners. BSAS uses an outside credit card processing company to bill website users for services. BSAS partners with other parties to provide specific services, such as a secured site for registrations and related financial transactions. If a user signs up for these services, BSAS will share his, her or its name or other contact information that is necessary for the third party to provide services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services, and you shall hold harmless BSAS for any misuse of your information by such a party. BSAS reserves the right to disclose your personally identifiable information as required by law and when BSAS believes that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order or legal process served on our website.   6. Technical Matters. BSAS makes no warranties regarding the availability and performance of any hardware, software, or technical systems used to provide the Exam. You recognize that Internet servers and links are susceptible to crashes, outages, viruses, and down time and that often these down times are beyond the control of BSAS. BSAS may also, at its own discretion, temporarily suspend all service for the purpose of repair, maintenance, or improvement of any of its computer systems. You agree to hold BSAS harmless for any damage or loss of information caused by such down times and technical issues. BSAS does not make any representation or warranty that its files are free of viruses, worms, Trojan horses or other codes that include or manifest contaminating or destructive characteristics. If you experience technical problems, it is your responsibility to resolve such issues and to inform BSAS of such.
  7. INDEMNIFICATION. THE ENTIRE RISK ASSOCIATED WITH THE USE OF THIS WEBSITE AND THE EXAM IS ASSUMED BY YOU. These Terms and Conditions shall be governed by the laws of the Commonwealth of Massachusetts, without regard to any conflicts of laws provisions, and you agree to submit to the exclusive jurisdiction of a court of competent jurisdiction located in the Commonwealth of Massachusetts in the event of any dispute related to these Terms and Conditions or the Exam.
  9. If any portion of these Terms and Conditions are held to be void and of no effect, it will not affect the enforceability of the remaining provisions.
